These terms and conditions shall apply from the moment a customer submits a booking or booking enquiry through the website of Kima Surf. By submitting a booking or booking enquiry, the customer acknowledges that they have read, understood, and agreed to be bound by these terms and conditions, including the limitation of liability.

The customer understands that the submission of a booking or booking enquiry constitutes a contractual agreement between themselves and Kima Surf, and they are obligated to comply with all the terms outlined herein.

It is the customer’s responsibility to carefully review these terms and conditions before submitting a booking or booking enquiry. If the customer does not agree with any part of these terms and conditions, they should refrain from submitting a booking or booking enquiry.

The customer acknowledges that any additional agreements, understandings, or representations made between themselves and Kima Surf, whether written or oral, are superseded by these terms and conditions unless explicitly stated otherwise in writing by Kima Surf.

By submitting a booking or booking enquiry through the website, the customer affirms that they are legally capable and authorized to enter into this agreement and that they are at least 18 years of age or have obtained the necessary consent from a parent or legal guardian.

These terms and conditions, including the limitation of liability, shall remain in full force and effect throughout the entire duration of the customer’s engagement with Kima Surf, including the provision of services, activities, or any other arrangements made by Kima Surf.

The reservation becomes valid once the online registration is submitted. Afterwards, customers will receive a confirmation of their reservation, along with helpful suggestions on how to prepare for the trip.

Please note that the company reserves the right to confirm a reservation within 24 hours of receiving the online registration. Once the booking is confirmed, the reservation will be processed, and the full amount must be paid.

In order to secure the booking, the participant is required to make the full payment through a bank transfer or other available payment methods as indicated in the reservation confirmation. Any associated bank transfer fees or currency exchange fees are the responsibility of the participant and must be covered by them.

ABOUT

THE

SURF

HOLIDAY

The surf boat charter includes surf guiding to several spots around the Mentawai Islands. Every customer has the option to join up to 3 sessions per day. However, the sessions are based on the daily weather conditions and can’t be guaranteed. As a general rule, there is no surfing on arrival and departure day. Any surf equipment such as surfboards, wax, leashes, and sunscreen are not included in the package.

For closed port situations or bad weather, exchange products and/or other alternatives will be offered. Rainy or cloudy weather is no valid reason for cancellation, and we strictly follow the harbour master’s recommendations on when to cancel a tour. In the event of poor weather or surf conditions, the guest shall have no claim against Kima Surf Mentawai or the operators.

Kima Surf, its subsidiaries, and its operators reserve the right to rearrange the order of any itinerary, to cancel or substitute elements of any schedule without notice when local conditions force such changes. Kima Surf and the surf guides on the boat can prohibit participation in surf sessions at their discretion based on a lack of respect for surf etiquette and regulations or the handling of any marine life. In such cases, we will not provide a refund for the missed surf session.

Additional costs that may apply to joining the Surf Charter due to delayed arrival or other travel disruptions won’t be covered by Kima.

Missed surfing sessions do not result in a reimbursement claim. If the participant cannot surf due to ill health while on board, please understand that there will be no refund given. If required, a letter for travel insurance purposes to claim the value of missed surf sessions can be provided. For illnesses prior to joining, please refer to the cancellation policy.

PREREQUISITE

FOR

PARTICIPATION

The participant explicitly declares that there are no medical reservations as far as their active surfing is concerned. For participants who are minors, their parents or legal guardians must waive any responsibility for their participation in the activity.

LIABILITY

The company is not liable for damages as a result of personal injuries.

The company’s liability for damages that are not personal injuries are limited to the triple journey price. Liability for the loss of or damage to participants’ property (like for example surf boards) on the part of the organiser shall be excluded. We recommend a private baggage/surf board insurance and health insurance for the respective period. The organiser’s equipment and vehicles should be treated in due form. The participant shall be liable for damages in the case of negligent or wilful damage or loss. In the case of damage to the vehicles by a third party in the Indonesian traffic, costs will be carried jointly by everyone in the car involved.

1. Coverage of injury:

“The participant acknowledges that Kima Surf is not responsible for any injuries, damages, losses, or delays that may occur both during organized Kima activities and onboard premises. The participant agrees to participate in all activities at their own risk and holds Kima Surf harmless from any liability arising from personal injury, including death, whether caused by negligence or otherwise, during the entire duration of the trip.”

2. Exclusion of third-party actions:

“The participant acknowledges that Kima Surf shall not be held liable for any actions or omissions of third parties, including third-party service providers, that may result in loss, damage, cost, expense, or delay. This includes but is not limited to accommodations, transportation, and any other services arranged by third parties.”

3. Failure to comply with obligations:

“The participant acknowledges that they are responsible for complying with all obligations, rules, and instructions provided by Kima Surf. Kima Surf shall not be liable for any loss, damage, cost, expense, or delay suffered or incurred due to the participant’s failure to comply with any of their obligations, including but not limited to safety guidelines, activity instructions, or any other requirements communicated by Kima Surf.”

4. Failure to possess required travel documentation:

“The participant acknowledges that it is their sole responsibility to possess, obtain, and maintain all necessary travel documentation required for the trip, including but not limited to valid passports, visas, health certificates, and any other documents as required by the relevant authorities. Kima Surf shall not be responsible for any loss, damage, cost, expense, or delay suffered or incurred due to the participant’s failure to possess, obtain, or maintain the required travel documentation.”

5. Failure to follow instructions:
